Wildfires across the United States are becoming increasingly common, but evidence suggests that many of these fires have been preventable. Maui’s Lahaina Fire is, no doubt, the most devastating fire Hawaii has experienced. This truly tragic wildfire has stolen the lives of thousands of innocent people and families. The sights and smells of seeing your property and the land you love charred black is not something most people understand. But experiencing death of a loved one due to the senseless, preventable wildfires is beyond words. We want to help.

Our Hawaii Maui wildfire lawyer team is led by Hawaii-trained and licensed physician and lawyer Dr. Brad Bradshaw. We understand what it’s like to lose someone we love in the most senseless of ways. We also know local laws and are dedicated to protecting and advocating for our neighbors and community.

What Can I Do if I Lost a Loved One in Maui’s Lahaina Fire?

At the time of this post, 115 people have been confirmed dead and hundreds more are missing. Every one of those who died was someone’s child, someone’s partner, someone’s friend. Every single person was loved by someone, and there is nothing that can ease the pain for those left behind.

But there is justice, and there is prevention. That’s where we come in.

Strong evidence suggests that this horrific fire was human-caused and that these senseless losses did not have to happen. OnderLaw has a long history of holding corporations and other entities accountable for the harm they have done, and we are honored to stand with Hawaii fire victims by protecting their rights, honoring those who have been lost, and seeking accountability.

Never again should a fire like this happen. We are dedicated to ensuring that victims receive justice and that those responsible will not ever repeat the careless actions they took — and failed to take — and cause more harm to our friends and neighbors.

If you suffered losses, including the tragic loss of a loved one or even destruction of your business or property due to the Lahaina Fire, first, we offer our sincere condolences. We understand how deeply painful these losses are.

How Did the Lahaina Fire Start?

According to video footage from near the Maui Bird Conservation Center, sparks from a faulty power line ignited dry brush and quickly spread, causing widespread damage. Fueled by a deadly trifecta of low moisture, high winds, and steep canyons, the fire rushed toward Lahaina at remarkably high speeds.

Who Is Responsible for the Fire?

Though information is still becoming available, there are several entities that could potentially be held responsible for the Lahaina Fire:

  1. Hawaiian Electric. The electric company failed to maintain the power line that caused the strike, despite unusually dry conditions that should have prompted them to remain diligent. They also had no plan in place to cut power in vulnerable areas, knowing that the island was incurring high winds and was at an elevated level of fire danger. To make matters more inexcusable, the power company was warned of a potential repeat after a 2018 fire ignited due to a similar weather situation.
  2. Oil Companies. In 2020, Maui County filed a lawsuit against some of the world’s biggest oil and gas companies, alleging that they concealed and denied their knowledge that burning fossil fuels was dangerously changing the climate. These dramatic changes are believed to be at a tipping point and a serious contributing factor to causing an increase in wildfires worldwide.
  3. State of Hawaii and Maui County. Though the wildfire was racing toward residential areas, state and county officials failed to warn residents by utilizing the warning system specifically designed for emergencies such as these. Countless lives and property could have been saved if people had only been warned of the danger.
  4. State and corporate water entities. Long after the Maui fire is extinguished, the battle over water rights will continue to rage. Representatives of some subdivisions charred in the blaze say their requests for water for fire prevention were denied. Other communities say that water diverted to other areas left their neighborhoods vulnerable.
