The owners of bars, hotels, shopping malls, parking garages, apartment complexes and other businesses can be held liable when customers, patrons or residents are physically attacked, assaulted, sexually assaulted or raped in their buildings or on the parking lot of their premise. These attacks often result from an absence of security guards, negligent security and surveillance, or conditions such as, poor lighting, lack of security camera monitoring, broken locks or unlocked fence gates enabling access or the opportunity for an assailant to attack.
In addition, under Missouri dram shop liability laws, a bar owner, liquor store, or gas station convenience store may be liable for injuries caused by a customer who has been over served. Liability can also attack when alcohol is served to a minor or an obviously drunk or intoxicated customer.
