Mr. Kohlfeld, an employee of McCarthy Construction Company, fell forty feet through a hole located on the roof of the Bodine Aluminum Plant in Troy, Missouri. The hole was cut by Defendant Rock Hill Mechanical’s employees. Rock Hill Mechanical’s employees failed to properly cover the hole pursuant to OSHA requirements, Rock Hill’s contract with McCarthy, Rock Hill’s own safety manual and industry standards. Rock Hill claimed that McCarthy Construction Company was responsible for covering the hole.
McCarthy employees testified that they were not relying on Rock Hill to cover the hole because McCarthy was supposed to cover them. As a result of this fall, Mr. Kohlfeld sustained a traumatic brain injury and back injury which rendered him permanently and totally disabled.
The jury returned a unanimous verdict after a seven day trial on March 22, 2005 for $9,000,000.00; a $6,500,000.00 for Mr. Kohlfeld and $2,500,000.00 for Marybeth Kohlfeld for the severe injury suffered by her husband. This is the largest verdict in Jefferson County history.
