$1,500,000 - Premises Liability and Third Party Criminal Acts (Assault & Rape)

On March 5, 2000, at approximately 3:30 a.m., the plaintiff, a 22 year old woman, intended to visit a friend at Plaza Square Apartments located in the City of St. Louis when she was abducted and sexually assaulted off of the premises. As she exited the outer door of the vestibule, she was abducted on the apartment’s sidewalk by an unknown third party who had a box cutter and was raped. The assailant was never found. Plaintiff alleged defendants Plaza Square Apartments, LLC, the apartment complex owner and CMS, Inc., the apartment complex manager, failed to provide adequate security on the premises. The parties settled the case in mediation for $1,500,000.
